Terms and conditions of use of Gift Card Paradigma
TERMS AND CONDITIONS OF USE OF THE GIFT CARD PARADIGM
1. Introduction
1.1 GIFT CARD PARADIGM ("GIFTKORT") is a service provided by society THISCLOSE - UNIPESSOAL LDA, NIPC 517401657, with headquarters at Rua Braamcamp, nº 12, 3rd Esq., 1250-050 Lisbon ("THISCLOSE").
1.2 When purchasing or using a GIFTKORT, the customer acknowledges and accepts that the supply, management and validity contract is established exclusively with THISCLOSE.
1.3 Paradigm acts only as an intermediary, providing the connection between the end customer and THISCLOSE.When making the purchase of GIFTKORT, the customer acknowledges and accepts that the contract for the supply of Geschenkartenisestablished exclusively between the customer and the THISCLOSE. Paradigm assumes no responsibility for issues related to the order, payment, delivery, return or use of the purchased products.
1.4. Paradigm limitsits responsibility to the dissemination and promotion of GIFTKORTintheir channels. All matters relating to the purchase, use and support are the sole responsibility of THISCLOSE.
2. Definitions
2.1.GIFTKORT: An offer voucher available in digital or physical format, usable in the indicated establishments.
2.2.BENEFICIARY:The person who uses the Gift Cardtomake a transaction.
2.3.EMITTER: Thisclose - Unipessoal Lda, responsible for the issue and management of Karta diyariyê.
2.4.CLIENT: The person who acquires the Gift Card, and may or may not be the beneficiary.
3. Availability
3.1. GIFTKORTisavailable in predefined values: 50€, 100€, 150€, 200€, 250€, and 300€.
3.2 Other values may be available, from time to time, being announced on the website at the time of purchase.
3.3 The acquisition of GIFTKORTissubject to the availability indicated on the website and the payment made by the customer.
4. Validity
4.1. GIFTKORTisvalid for 1 (one)year from the date of purchase, unless expressly stated otherwise in the act of acquisition.
4.2. After the end of this period, the remaining balance GIFTKORTexpiresautomatically and cannot be used or refunded.
4.3 The validity of GIFTKORTmaynot be extended except by express decision of THISCLOSE.
4.4 The customer is responsible for verifying the validity of GIFTKORTbeforeor using.
5. Utilization
5.1. GIFTKORTisvalid only in spaces operated by ParadigminPortugal, unless otherwise indicated.
5.2 GIFTKORTisvalid for a single transaction, unless otherwise indicated at the time of purchase.
5.3 If the transaction value is less than the balance available on the Gift Card, the remaining balance will be automatically cancelled and cannot be used in future transactions.
5.4 If the transaction value exceeds the available balance on GIFTKORT, the beneficiary is responsible for the payment of the remaining amount at the time of purchase.
5.5. The GIFTKORTcannotbe used for the purchase of other Gift Cards or products from the online store, unless expressly indicated otherwise by QUESTA CHIUSURA.
6. Reservation and Prior Communication
6.1 The use of GIFTKORTinany of the restaurants of Paradigmissubject to the availability of the selected restaurant.
6.2 The beneficiary is responsible for making the reservation at least 48 hours in advance and must inform, at the time of booking, the intention to use the GIFTKORT as a form of payment.
7. Delivery Formats
7.1.Digital Format: OR GIFTKORTwillbe sent to the email provided by the customer at the time of purchase, at no additional cost.
7.2.Physical Format: Available at an additional cost, will be mailed to the address indicated at the time of purchase.
7.3 QUESTA CHIUSURA is not responsible for delays in delivery due to incorrect information provided by the customer or situations beyond its control, such as strikes or extreme weather conditions.
8. Loss, Theft or Damage
8.1. GIFTKORTisequivalent to money and must be treated with care, being the responsibility of the customer to take care of it.
8.2 QUESTA CHIUSURA is not responsible for KARTÊN DIYARIYÊlost, stolen or damaged, or for any misused balance.
8.3 QUESTA CHIUSURA will not be liable for fraudulent or unauthorized use of GIFT CARD.
8.4 In case of loss or theft, the customer may contact QUESTA CHIUSURA presentingthe proof of purchase. The replacement will be evaluated if the GIFTKORT has not yet been used and will be decided solely by QUESTA CHIUSURA.
9. Refunds and Transferability
9.1 GIFTKORTisnot refundable or convertible into cash, except when required by applicable law.
9.2 The HIGH GIFTCistransferable and may be used by third parties provided that it possesses the unique code (serial number) associated with the GIFTET KARTU.
9.3 The use of GIFTKORTbythird parties does not exempt the original customer from the responsibilities provided for in these Terms and Conditions.
10. Limitations of Use
10.1 GIFTKORTmaynot be used in conjunction with other promotions, discounts or offers, unless expressly stated otherwise by THISCLOSE.
10.2 Products or services purchased with the GIFTKORTaresubject to the general conditions of sale applicable in the spaces where it is used.
10.3 GIFTKORT maynot be used for split payments on different occasions, being for single use, unless expressly indicated otherwise.
11. Returns Policy
11.1 GIFTKORTisnot refundable after issue, except when required by applicable law.
11.2 If the customer identifies an error in the GIFTKORT(e.g. incorrect value or shipping to the wrong address), you should report to THISCLOSEwithina maximum period of 5 (five) working days after purchase. THISCLOSEwillassess the situation and be able to correct the error, provided that the GIFTKORThasnot yet been used.
11.3 We do not accept returns of KARTÊN DIYARIYÊpurchasedin promotional campaigns or with discounts applied.
11.4 In the event of a technical defect or proven error of emission by THISCLOSE, the customer will be entitled to issue a new GIFTKORTwiththe correct amount, provided that the original balance remains intact.
11.5 The Client you will not be able to request a refund or refund of balances remaining in the HIGH GIFTCafterits expiry date.
12. Changes to Terms and Conditions
12.1 THISCLOSE reserves the right to change these Terms and Conditions at any time, with immediate effect after publication on website.
12.2 Changes to the Terms and Conditions apply only to KARTÊN DIYARIYÊacquiredafter the date of entry into force of such amendments.
12.3 It is recommended that customers check the Terms and Conditions regularly to stay informed of any changes.
13. Applicable Legislation and Dispute Resolution
13.1 These Terms and Conditions are governed by Portuguese law.
13.2 Any dispute arising from the purchase, use or management of GIFTKORTwillbe resolved in the courts of the Lisbon Region, waiving any other forum, unless otherwise provided by law.
